Terms of Service

These Terms of Service ("Terms") govern your access to and use of the BookingSprint platform ("Service"), operated by BookingSprint ABN 47 515 879 041 ("we", "us", "our"). By creating an account, clicking "I agree", or using the Service, you agree to these Terms in full. If you do not agree, do not use the Service.
1. Overview of the Service
BookingSprint is a software-as-a-service (SaaS) platform designed for Australian trade and service businesses. The Service provides:
- Automated SMS lead capture for missed calls via Twilio
- AI-powered booking conversations and scheduling
- Google Calendar integration for appointment management
- Customer relationship and lead management (CRM)
- Business analytics, conversion tracking, and reporting
- Customisable booking landing pages for your customers
- Call forwarding and voicemail-to-SMS via Twilio
- Email notifications (booking confirmations, welcome emails, password resets)
2. Eligibility & Consent
You must be at least 18 years of age and have the legal capacity to enter into a binding agreement. By creating an account, you:
- Represent that you meet these requirements and that the information you provide is accurate
- Consent to the collection, use, and processing of your data as described in these Terms and our Privacy Policy
- Acknowledge that SMS messages will be sent and received on your behalf through third-party providers (Twilio)
- Acknowledge that conversation data may be processed by AI services (OpenAI) to provide booking assistance
We record your consent (timestamp and Terms version) at the time of account creation.
3. Account Registration
- You may register with an email address and password, or through Google OAuth single sign-on.
- When registering via Google OAuth, we receive your email address, name, and profile picture from Google.
- You are responsible for maintaining the confidentiality of your login credentials.
- You must notify us immediately at [email protected] if you suspect unauthorised access to your account.
- Account sessions are secured with JWT tokens stored in HttpOnly cookies, which expire after 24 hours.
- We implement account lockout and rate limiting to protect against brute-force attacks.
- We reserve the right to suspend or terminate accounts that violate these Terms.
4. Subscription Plans & Billing
- Free Trial: New accounts begin with a 14-day free trial with full Pro-level features. No credit card is required during the trial.
- Basic Plan — $79.99 AUD/month:
- Booking landing page, missed-call SMS with booking link, Google Calendar sync, email support
- 30 AI conversations per month included
- Overage: $2.50 per additional conversation, capped at $50/month in overage charges
- Pro Plan — $149.99 AUD/month:
- Everything in Basic plus AI auto-booking, advanced AI conversations, lead scoring & ROI analytics, priority support, and data export
- 100 AI conversations per month included
- Overage: $1.50 per additional conversation, no cap
- A "conversation" is defined as a unique lead/customer that receives at least one AI response within a billing month. Multiple messages within the same lead conversation count as one conversation.
- All prices are in Australian dollars and inclusive of GST where applicable.
- Payments are processed securely through Stripe. We do not store your credit card details on our servers — all payment data is handled entirely by Stripe (PCI-DSS compliant).
- Subscriptions renew automatically on a monthly basis. You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing cycle.
- Unused AI conversations do not carry over to the next billing month.
5. SMS & Voice Usage
- SMS messaging and call forwarding are provided through Twilio. Each account is assigned a dedicated Australian Twilio phone number.
- When a customer call is missed, the Service automatically sends an SMS from your assigned Twilio number containing a booking link.
- Inbound customer replies are received via Twilio webhooks and stored as conversations in the platform.
- Call forwarding uses Twilio TwiML to redirect incoming calls to your personal phone number.
- A daily cap of 200 SMS per account applies to prevent abuse and unexpected costs.
- You must comply with Australian spam laws (Spam Act 2003) and the Do Not Call Register Act 2006. You must not use the Service to send unsolicited commercial messages.
- SMS recipients must be your genuine customers or leads — people who have contacted your business or provided consent to be contacted.
- The Service automatically honours STOP requests from SMS recipients.
- We reserve the right to suspend SMS functionality if we detect abuse, spam, or unusual volume.
6. Data We Collect & How It Is Used
When you use the Service, we collect and process the following data. Full details are in our Privacy Policy.

7. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law
- Send spam, unsolicited messages, or harassing communications
- Attempt to gain unauthorised access to any part of the Service or its infrastructure
- Reverse-engineer, decompile, or disassemble any part of the Service
- Use the Service to store or transmit malicious code
- Impersonate another person or business
- Resell or sublicense access to the Service without our written consent
- Use the AI features to generate content that is illegal, harmful, or violates third-party rights
8. Your Data & Content
- You retain ownership of all data you submit to the Service (business information, leads, messages, booking records).
- You grant us a limited licence to process, store, and transmit your data solely for the purpose of providing the Service.
- We do not sell your data to third parties. See our Privacy Policy for details.
- You are responsible for ensuring you have appropriate consent to store customer data in the Service, in accordance with the Australian Privacy Act 1988.
- You are the data controller for your customers' personal information. We act as a data processor on your behalf.
9. Third-Party Services & Integrations
The Service relies on the following third-party providers to deliver its features. Your use of these integrations is also subject to their respective terms:

We are not responsible for the availability, performance, or data practices of third-party services. Each provider operates under their own terms and privacy policies.
10. AI Features & Data Processing
The Service uses artificial intelligence (powered by OpenAI) to enhance your experience:
- AI Booking Chat: When a customer sends an SMS to your Twilio number, their message is processed by OpenAI's API to generate an intelligent booking response. This is available on both Basic and Pro plans (subject to monthly conversation limits).
- Lead Analysis: AI may analyse lead data to provide scoring, insights, and recommendations for your business.
- Platform Analytics: We use AI to analyse aggregated, anonymised platform data (signup trends, activity patterns, conversion rates) to improve the Service.
- Data minimisation: We send only the minimum necessary data to AI providers and anonymise personal information where possible.
- No model training: OpenAI does not use data sent via their API to train their models. Data is processed and discarded per OpenAI's API data usage policy.
11. Google Calendar Integration
- You may optionally connect your Google Calendar to sync bookings. This requires granting BookingSprint OAuth access to your Google Calendar.
- We access your calendar to: read existing events (to check availability), create new booking events, and update events when bookings change.
- Calendar access tokens are encrypted and stored securely. You may revoke access at any time from your account settings or your Google Account security page.
- We do not access any Google data beyond what is required for calendar functionality.
12. Intellectual Property
All rights, title, and interest in the Service (including software, design, trademarks, and documentation) remain our property. These Terms do not grant you any rights to our intellectual property beyond the limited right to use the Service as described herein.
13. Service Availability & Modifications
- We aim to provide reliable, continuous service but do not guarantee 100% uptime.
- We may perform scheduled maintenance with reasonable notice where possible.
- We reserve the right to modify, update, or discontinue features of the Service. Material changes will be communicated via email or in-app notification.
- Changes to pricing or plan inclusions will be communicated at least 30 days in advance and will not affect your current billing cycle.
14. Limitation of Liability
To the maximum extent permitted by Australian law (including the Australian Consumer Law):
- The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.
- We are not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, or loss of data.
- We are not liable for SMS delivery failures, delays, or costs incurred through Twilio's network.
- We are not liable for AI-generated responses that are inaccurate or inappropriate — you should review AI interactions and configure your AI assistant settings appropriately.
- Our total aggregate liability for any claim arising from or related to the Service shall not exceed the total amount you paid to us in the 12 months preceding the claim.
- Nothing in these Terms excludes or limits consumer guarantees under the Australian Consumer Law that cannot be excluded or limited.
15. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, your customers' use of your booking page, or your violation of any applicable law or regulation.
16. Termination
- You may close your account at any time by contacting [email protected].
- We may suspend or terminate your account immediately if you breach these Terms, engage in abuse, or if required by law.
- Upon termination, your right to access the Service ceases. Your assigned Twilio phone number will be unassigned and returned to our pool.
- We may retain certain data as required by law or legitimate business purposes (see our Privacy Policy).
- You may request export or deletion of your data within 30 days of account closure.
17. Governing Law & Disputes
- These Terms are governed by the laws of New South Wales, Australia.
- Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales.
- Before commencing legal proceedings, you agree to first attempt to resolve any dispute informally by contacting us at [email protected].
18. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via email or a notice within the Service at least 14 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms. The current version number is displayed at the top of this page.
